We are marketing a client website that encourages users to create an account. The registration allows access to message boards and other interactive features.
During the registration process, users are given the option to subscribe to a weekly newsletter. Currently the client does not have any policy on the site that says they will send the registrant emails beyond the newsletter, which is what the client is looking to send... member updates, perhaps four times a year. These emails would go to every registered member, not just the newsletter subscribers.
My question and how this jives with the CAN SPAM Act is this: Can we send any user, regardless of their subscription to our weekly newsletter, a "member update" from time to time without an opt-in? Or, can we make receiving the "member update" email a requirement if you want to be a registered user? I'm all for opt-in but the client does not want any member to not receive the member update emails.
